    Avid Free DV EULA

    Hello,

    Can anyone link me to a copy of the eula for FreeDV?

    I'm curious about "how free is it"...

    Free DV is no longer an Avid product. You may find old links to it out on the web though.

    I'm aware of the fact it was discontinued, but i'm just looking for its eula. Couldnt really find it anywhere..

    Any specific ideas where (just the eula) can be?

    Why would you need a license agreement for a product that doesn't exist?

    It is no longer posted on Avid's web servers (which was the only place it could be found to begin with) so I'm betting you will have a hard time finding it.

    As the product has been EOL, the EULA is probably no longer posted.  What are you looking to find out?  If you're wondering if it is legal to redistrubute the software, it is not.  I don't need to know the EULA, that's just software in general.

    I wasn't looking to see about distribution, but rather to see if it was free for corporations as well as individuals. curiousity more than anything else, really.

    It IS interesting. The eula talks of a "single user" but there's no restriction- as far as I can see- on commercial use- in fact I'd bet the eula is identical to all the other avid products.

    FWIW free dv is still out there, downloadable from other sites. I'm not endorsing this, and I don't think the "eula" would cover any copy not obtained from avid.

    I value the copies that I own: I have several, all obtained legally. I've moved it from my desktop to my laptop, and cut a range of things on it. I THINK it'd be ok to cut "work" jobs on it, but wouldn't want to gaurantee that.

    But I'll continue to use it for a while- its a great tool!

    I don't believe we ever had a restriction on commercial use of Avid Free DV since it really was such a watered down version of our "for pay" products. So long as you aren't reverse engineering it, selling copies of it, etc. you should be ok to use it for whatever your needs are. The original idea of Free DV was you get to understand how the Avid interface works, and then you buy one of our other products to be able to do more.

    I've done many professional jobs with AvidFreeDV. And since they're not supporting it anymore, it would seem that it's been abandoned. Technically and legally, I may be wrong (so I'm not advocating anything here), but if AVID leaves FreeDV laying on the curb, then I don't see how they can be upset when you load it in your truck and put it in your dorm room.

    AVID has made no reply so far to this thread, so let's make it clear:

    AVID - since this software has been abandoned, I think it's fair to say that all users in every country can use AVID FreeDV in any manner they wish, for any purpose, with any activation key acquired in any way from any person or network in any time or place.

    If this is not the case, I think an AVID representative should respond below with the specific limitations. If there is no response from AVID on their own forum, I think it's safe to say that the above statement is true, and AVID agrees to its content. Let's see what happens.

    This should be clearly and completely understood...

    No statement made on these forums by any Avid personnel OTHER  than Avid's legal department should be taken or considered as legally binding in any way shape or form. Nor does any statement on these forums from Avid personnel or users relieve any participant from any legal obligations incurred or implied in Avid's End user Licenses for any product.

    ...and Avid  legal will NEVER post here.

     

    If  that is not clear, then I'll be happy to get you in contact  with Avid's legal department.

    This has been discussed plenty in the past.  Here's a post where I attached the license agreement.  There's nothing better to answer the question than that.  It's direct from Avid, it's official and it's legally binding.

    What you're all basically saying, is that a EULA is in place for a product, which AVID does not even recognize anymore. That seems to be about as messed up as imaginably possible.

     

     If AVID has a position on this EULA thing (which is not nearly as cut and dry as folks are making it sound) then why don't they put up a page stating their clear position? The stuff posted thus far in this thread may be valid - although remember this is for a DEAD product.  And stating that is is clear in a patronizing way, will only weaken your argument to the point of irrelevance. If you think "they already have made it clear!", well you're wrong. Things have changed since that EULA was written. Let's have something WRITTEN AFTER THE PRODUCT WAS KILLED from AVID clearly stating their position. Until they do so, they are not helping themselves (and merely saying that they do not care through their passive additude).
